General Terms and Conditions — Koreesta

These General Terms and Conditions (“Terms and Conditions”), together with our Privacy Policy, govern your use of Koreesta’s services. These services are accessed through our online platform, which includes our website www.koreesta.com and its related sub-domains (collectively, the “Koreesta Platform”). By accessing or using the Koreesta Platform, you agree to be bound by and to comply with these Terms and Conditions.
The Koreesta Platform is available to travellers worldwide. These Terms and Conditions are governed by the laws of Sri Lanka (see Section 18). Where you are a consumer, any mandatory consumer-protection rights that apply in your country of residence remain unaffected by this choice of law.
These Terms and Conditions have been drafted, and shall be construed, in English. Any translation is for reference only. In the event of any inconsistency between the English version and a translated version, the English version shall prevail.
1. About us
Koreesta (Private) Limited, registered under the Companies Act No. 7 of 2007 with the Registrar of Companies under number PV00362439, with its registered address at No. 878/5, Negombo Road, Mabola, Wattala, Sri Lanka, is the operator of the Koreesta Platform. In these Terms and Conditions, “Koreesta,” “we,” “us,” or “our” refers to Koreesta (Private) Limited.
“Koreesta Parties” means Koreesta together with its affiliates, its distribution partners, affiliate partners and content-creator partners, and each of their respective officers, directors, employees and agents. For clarity, Suppliers are not Koreesta Parties.
We operate the Koreesta Platform as an intermediary marketplace through which independent local activity providers (“Suppliers”) offer authentic travel experiences — including tours, attractions, workshops and other tourist activities (“Activities”) — for purchase. We onboard direct operators only; we do not accept resellers, aggregators, online travel agencies or unregistered private guides.
We act as the commercial agent for Suppliers. This means we facilitate bookings, but the Activities themselves are provided by the Suppliers, not by Koreesta. Suppliers operate the Activities and are independent contractors — not agents or employees of Koreesta. Koreesta and the Koreesta Parties are not responsible or liable for any acts, errors, omissions, representations, warranties, breaches, negligence or misconduct of Suppliers, nor for any damages, personal injury, death or other loss or expense arising from bookings or Activities. All Activity information on the Koreesta Platform — descriptions, photographs and related content — is provided and maintained by the Suppliers who offer those Activities, and each Supplier is responsible for its accuracy and for delivering the Activity as described.
2. Scope
2.1. These Terms and Conditions apply to all visitors and users (“Users”). As soon as you use any part of the Koreesta Platform, you agree to comply with these Terms and Conditions. If you do not wish to be bound by them, do not use the Koreesta Platform.
2.2. These Terms and Conditions apply to all of our services unless more specific terms apply to a particular service, in which case we will clearly inform you. Any other terms that conflict with or differ from these Terms and Conditions will not apply unless we have expressly agreed to them in writing.
3. What we do
3.1. When you book an Activity, the contract for that Activity (“Service Agreement”) is concluded exclusively and directly between you and the Supplier. You are not buying anything from Koreesta; you are buying directly from the Supplier, who is responsible for providing the Activity. The Service Agreement is concluded by us on behalf of the Supplier, as their commercial agent, authorizing us to (i) conclude transactions directly between you and the Supplier for the Supplier’s account, and (ii) collect payments from you on behalf of and for the account of the Supplier. We do not offer any Activities ourselves and do not become your contractual partner to any Service Agreement.
3.2. We receive a commission from the Supplier for brokering the Service Agreement. You acknowledge that the price shown on the Koreesta Platform (“Posted Price”) and the amount you pay at checkout (“Booking Price”) include the commission Koreesta earns, which is paid by the Supplier for services we provide to the Supplier (such as facilitation, customer support and other brokering services).
3.3. You can filter and search Activities by different parameters. Where multiple Suppliers offer matching Activities, Koreesta ranks them using a combination of factors designed to enhance traveller experience and satisfaction, including (but not limited to) relevance, popularity, diversity, customer ratings, reliability and performance over time. No specific placement or ranking position is guaranteed. New Activities are initially ranked based on an internal assessment, and our ranking logic is updated regularly to reflect recent performance.
3.4. We reserve the right to impose conditions on the use of the Koreesta Platform, including access to certain features, based on factors such as payment history or documentation (e.g., identity verification, payment receipts). If we suspect fraud or a violation of these Terms and Conditions or a Service Agreement, we may restrict or cancel your bookings.
3.5. We are not obliged to improve, update or continue to make available the content, functions or services provided via the Koreesta Platform, and may discontinue our services at any time. However, if you have already concluded a Service Agreement with a Supplier, that Service Agreement still applies.
4. Use of the Koreesta Platform & Your Account
4.1. The Koreesta Platform is provided for your personal, non-commercial use only. Use for business, commercial or professional purposes — including the commercial resale of tickets or Activities for profit — is strictly prohibited. Using automated systems (bots, scrapers, spiders, crawlers) to access, extract, copy or index content or data from the Koreesta Platform without our prior written consent is also strictly prohibited.
4.2. Browsing and booking. You may browse the Koreesta Platform without creating an account. To make a booking, you may either check out as a guest with immediate payment, or create a Koreesta account. Certain features — including Reserve Now, Pay Later (Section 8) — are available only to registered customers who are logged in.
4.3. Creating an account. To create a Koreesta account, provide your full legal name and email address and set a password, or register using your Google account. You must be at least 18 years old and able to enter into a binding contract. If you are under 18, you may only use the Koreesta Platform and make bookings through a parent or guardian who accepts these Terms and Conditions on your behalf.
4.4. You are responsible for keeping your account credentials confidential and must not disclose them to any third party. You are responsible and liable for all activity conducted through your account, and must notify us immediately if you suspect your credentials have been lost, stolen or compromised.
4.5. You may only create one account for yourself, and you may not transfer your account to anyone else.
5. Communication Tools — Host Chat, Itinerary Builder & Customisation
A core part of Koreesta is direct interaction between travellers and local hosts. Alongside our curated Activities (each of which may offer several options), you can use our built-in Communication Tools to shape your experience:
5.1. Chat & itinerary builder. Through the in-platform chat and itinerary builder, you may communicate directly with a Supplier to (i) propose changes to an existing Activity or one of its options, or (ii) co-create an entirely new, customised experience with the host.
5.2. How a customised booking becomes a contract. Any customised or co-created Activity becomes a Booking — and a Service Agreement with the Supplier — only once it has been confirmed and paid for through the Koreesta Platform in the normal way. The price and terms of a customised Activity are set by the Supplier and shown to you before you confirm.
5.3. Keep communication on-platform. To protect both travellers and hosts, all communication and transactions relating to an Activity must stay on the Koreesta Platform. You must not use the Communication Tools to share or request private contact details (such as phone numbers or email addresses), or to arrange booking or payment outside the Koreesta Platform.
5.4. Automated protection. Our Communication Tools are secured to automatically detect and block messages that attempt to transmit contact details or to move a transaction off-platform, and a warning will be shown. Repeated attempts will trigger enforcement: for a Supplier, three (3) or more such attempts may result in that Supplier’s Activities being removed from the Koreesta Platform for five (5) days from the incident; for a customer, repeated attempts may result in restriction or suspension of the account. Messages sent through the Communication Tools may be monitored and stored by Koreesta for safety, security and compliance purposes.
6. Customer Service
In our role as commercial agent, we assist Suppliers with customer-service requests. If you have a question, complaint or need help with a booking, you can contact our customer-service team through our Help Center at www.koreesta.com/helpcenter using the contact form provided there. We typically respond within 24 hours, and at the latest within 48 hours. You can also communicate directly with the Supplier through the in-platform host chat. In an emergency, the Supplier’s contact details can be found on your voucher or ticket.
7. Best Price Matching
7.1. If you find the same Activity you booked via the Koreesta Platform offered at a lower price elsewhere online, we will refund you the difference, provided you can supply proof and the alternative offer meets all of the following:
- Same Activity with identical conditions (date, city, number of participants)
- Same services and inclusions
- A lower price than you paid on Koreesta
- Bookable with the same Supplier
- Currently available for booking
Offers available only to members of loyalty or reward programs, corporate rates, group rates, or other promotions not available to the general public are excluded.
7.2. Websites or platforms created solely to circumvent this policy are excluded. Koreesta may reject claims where there is evidence or reasonable suspicion of fraud, manipulation or abuse.
7.3. To claim, submit the link and/or a screenshot of the alternative offer upon request. We will verify it and, if the price is genuinely lower, refund the difference to your original payment method or as a Koreesta refund gift card.
8. Payment
8.1. The Posted Price applies to the Activity. The Booking Price is the Posted Price minus any applicable discounts. Unless otherwise agreed, the Booking Price is payable immediately upon booking. Koreesta cannot issue a tax invoice for an Activity (the Supplier is the seller); however, on request we can issue a payment confirmation for a completed booking.
8.2. Reserve Now, Pay Later. For selected Activities, registered customers who are logged in may choose the Reserve Now, Pay Later option. This option requires a valid card that remains valid at least until the Activity date. To confirm the reservation, we may place a nominal verification hold (which may be a zero-value authorization) on your card. We will then charge the Booking Price seventy-two (72) hours before the Activity begins. If that charge fails, you will have forty-seven (47) hours to complete payment manually; if payment is not received within that period, the booking will be automatically cancelled.
8.3. Payment collection & currencies. Koreesta is entitled to receive payments in the name of and on behalf of the Supplier as its commercial agent; once payment is successfully made to Koreesta, you have discharged your payment obligation towards the Supplier. Payments are collected in US Dollars (USD) or Sri Lankan Rupees (LKR), as displayed to you at checkout. If your payment card or account is denominated in another currency, your bank or card issuer will convert the amount at its own exchange rate and may apply its own fees, for which Koreesta is not responsible.
8.4. We serve as your point of contact regarding the Service Agreement and related payments, acting as commercial agent of the Supplier. If you wish to request a refund outside of our cancellation policy, you may contact us.
8.5. You must provide payment information truthfully and update it promptly if it changes. The permitted payment methods will be shown to you during checkout and include credit/debit cards and digital wallets (including PayPal and Apple Pay), processed through our payment gateway provided by Hatton National Bank PLC. The payment provider’s terms will apply, and it may charge additional fees. You confirm that you are authorized to use any payment method you select. We reserve the right to make certain payment methods conditional on a creditworthiness or fraud check.
8.6. Payments may be processed by a company we appoint as a payment processor (a “sub-agent”). Such payments are subject to the same terms as payments made directly to us; successful payment to the sub-agent likewise discharges your payment obligation towards the Supplier.
9. Gift Cards
Koreesta offers Gift Cards, which can only be redeemed on the Koreesta Platform. Gift Cards expire three (3) years from the end of the year in which they were purchased, unless otherwise required by law. There is no entitlement to a cash payout except where required by law. In the event of fraud, attempted fraud or suspected illegal activity connected with the purchase or redemption of a Gift Card, we reserve the right to close your account and/or require an alternative payment method. 10. Changes, Cancellations and Refunds
10.1. You may cancel a Service Agreement only in accordance with the cancellation conditions stated below, in the Supplier’s own terms for the Activity (“Supplier-Customer T&Cs”), in the Activity description, or on the voucher/ticket.
10.2. To avoid misunderstandings, all changes (e.g., rescheduling or changing participants) and cancellations must be made via the Koreesta Platform (using the Help Center). Changes or cancellations must be made in good time, which depends on the applicable cancellation period and the Activity’s availability — so please read the Activity page and any Supplier-Customer T&Cs carefully. The decisive factor for timeliness is when Koreesta receives your notification. If the conditions are met, we will issue a cancellation or change confirmation on behalf of the Supplier; keep it as proof.
10.3. We may notify you of changes or cancellations on behalf of the Supplier — especially at short notice — using your provided phone number and email address.
10.4. Unless different conditions are specified in the Activity description, the Supplier-Customer T&Cs, or on the voucher, the following applies:
- Cancellations made more than 24 hours before the Activity starts: full refund of the Booking Price.
- Cancellations made within 24 hours before the Activity starts, or no-show: no refund.
10.5. Refunds are issued to the original payment method. At your choice, a refund may alternatively be provided as a Koreesta refund gift card.
10.6. Koreesta refund gift cards: (i) are shown in your account and can be applied at checkout to reduce the Booking Price; (ii) are non-transferable and cannot be redeemed for cash; (iii) cannot be used past their expiry date; (iv) are forfeited if you delete your account; and (v) may be subject to a maximum balance shown in your account. We may change the usage terms of refund gift cards (value, usage, validity) where reasonably necessary.
11. Reviews and Other User Content
11.1. You may view reviews and content posted by other users. Reviews reflect personal opinions at a point in time; the Activity may have changed since a review was posted, and the volume of reviews should be considered alongside any single opinion.
11.2. You may write reviews of Activities you have purchased or post pictures (together, “User Content”). You are fully responsible for your User Content. You must not post User Content that: (i) is untrue or misleading; (ii) advertises third-party products, services or companies; (iii) was created in return for payment by a third party; (iv) was created by or at the direction of the Supplier; (v) violates the intellectual property, privacy or other rights of a third party; or (vi) contains links or references likely to impair third-party systems.
11.3. You must hold the necessary rights to any images you upload. Images showing other people may only be uploaded with those individuals’ consent.
11.4. User Content must not violate any law, public morality or third-party rights, and must not contain depictions of violence, pornography, discrimination, insults, racism, defamation or other illegal content.
11.5. You retain ownership of your User Content, but grant Koreesta a non-exclusive, sublicensable (through one or more tiers), worldwide, fully paid and royalty-free license, in any and all media now known or later developed, to use, reproduce, adapt, translate, create derivative works of, modify, publicly display, publicly perform, transmit and distribute the User Content, including (i) on or through the Koreesta Platform, (ii) through Koreesta’s distribution partners, and (iii) in online and offline marketing materials.
11.6. We may remove User Content at our discretion, for example where it violates this Section. We are not obliged to keep copies of User Content.
11.7. Koreesta and its partners may display advertisements alongside User Content. You are not entitled to compensation for such advertisements.
12. Responsible and Respectful Travel
Koreesta is built on authentic, ethical and sustainable tourism. When you book and take part in an Activity, you agree to:
- treat your host, their team and fellow participants with respect;
- respect local communities, customs, religious and sacred sites, and follow any dress codes or conduct rules;
- respect wildlife and the natural environment, and follow the host’s and any authority’s rules (including in protected areas);
- follow the Supplier’s reasonable safety instructions and eligibility requirements for the Activity.
We may cancel bookings or restrict accounts where a traveller’s conduct endangers hosts, other participants, wildlife or communities, or breaches these standards.
13. Data Protection
We collect and process your personal data in accordance with applicable law, including the Personal Data Protection Act No. 9 of 2022 of Sri Lanka (“ PDPA”) and, where they apply to you, the EU General Data Protection Regulation (GDPR) and the UK GDPR. 14. Assignment
You may not transfer or assign your rights and/or obligations under these Terms and Conditions, except for any claim for damages.
15. Severability
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions. Any invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid one; where applicable, the relevant statutory law shall apply in its place.
16. Termination
16.1. You may block, terminate or delete your Koreesta account at any time via the Help Center (using the contact form / “Delete account” request).
16.2. Koreesta may terminate these Terms and Conditions, your account or your access to the Koreesta Platform at any time with a notice period of one (1) week. However, termination will only become effective after any already-concluded Service Agreements have been performed or cancelled. The right to terminate for good cause remains unaffected.
17. Supplier — Service Agreement
17.1. Conclusion of contract with the Supplier.
17.1.1. When you select and purchase an Activity, you conclude a Service Agreement directly with the Supplier, for which we act as the Supplier’s commercial agent.
17.1.2. To book, you select the Activity, provide the required personal details, and choose a payment method. By booking, you submit a binding offer to conclude a Service Agreement with the Supplier. Your offer remains binding for two (2) working days. After we receive your offer, we will send an automatic booking confirmation on behalf of the Supplier. Check the confirmation immediately to ensure all details are correct.
17.1.3. For some Activities, the Supplier may require you to accept their own Supplier-Customer T&Cs during booking. By booking, you agree to be bound by them; please read them carefully (e.g., cancellation conditions). Nothing in the Supplier-Customer T&Cs affects your relationship with us or our legal rights. In the event of a conflict between the Supplier-Customer T&Cs and these Terms and Conditions, the provision more beneficial to you shall govern your relationship with the Supplier.
17.1.4. We accept your offer, in the name and on behalf of the Supplier, once you receive a booking confirmation. Where applicable, you will also receive a voucher or ticket (mobile or PDF) and a payment confirmation. We reserve the right to accept or reject offers at our discretion.
17.1.5. The Service Agreement is not documented in a separate contract; its content consists of the Activity you selected (its description), the applicable provisions of this Section, and any Supplier-Customer T&Cs.
17.2. Prices.
17.2.1. In most cases, Posted Prices include all taxes and fees. However, additional local taxes or fees may occasionally be levied locally; if so, this will be disclosed in the Activity description.
17.2.2. Posted Prices may be subject to special provisions, such as cancellation and refund policies — check the Supplier’s conditions before booking. The Posted Price or Booking Price may be higher or lower than prices for the same or similar Activity on other platforms or sales channels.
17.3. Provision of the Activity.
17.3.1. You must arrive on time at the meeting point stated in the Activity description or communicated by the Supplier. If travelling from abroad, you are responsible for obtaining the necessary travel documents (passport, visa) and complying with all applicable health and entry requirements.
17.3.2. The Booking Price does not include insurance. You are responsible for obtaining sufficient insurance coverage. We strongly encourage travel insurance, especially for Activities with outdoor or higher-risk elements. We do not operate tours, employ guides, or set or verify safety standards for Activities.
17.3.3. Suppliers are independent contractors, not agents or employees of Koreesta. We are not responsible or liable for any acts, errors, omissions, representations, warranties, breaches, negligence or misconduct by any Supplier, or for any personal injury, death, property damage or other damages arising from or related to the Activity.
17.3.4. For time and deadline calculations, the Supplier’s local time zone is decisive.
17.4. Further rights of the Supplier.
17.4.1. The Supplier may cancel the Activity on the agreed date without observing the standard cancellation period if circumstances beyond its control make performance impossible, significantly impeded, or dangerous (e.g., adverse weather, government actions, strikes, or other force majeure events). In that case, the Booking Price paid for the cancelled Activity is refunded. Any additional compensation claims must be directed to the Supplier.
17.4.2. The Supplier may exclude you from an Activity if (i) you do not meet the stated participation requirements, (ii) your participation would endanger yourself or others, or (iii) you disrupt the Activity. In these cases, the Booking Price is not refunded.
17.4.3. The Supplier may make immaterial changes to the itinerary where necessary due to unforeseen circumstances, including changing the start or meeting point, provided the new point is reachable from the original within 15 minutes on foot or by public transport. Such changes may be made up to 24 hours before the Activity and will be communicated by email or on the Koreesta Platform. Please check your email and communications regularly; if information conflicts, the details in the Supplier’s email prevail.
18. Governing Law and Dispute Resolution
18.1. These Terms and Conditions and our services are governed by the laws of the Democratic Socialist Republic of Sri Lanka, without regard to conflict-of-law rules. Where you are a consumer, any mandatory consumer-protection rights in your country of residence continue to apply and are not overridden by this choice of law.
18.2. In the event of a dispute, the parties will first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved, the parties irrevocably submit to the exclusive jurisdiction of the competent courts of Colombo, Sri Lanka, except where mandatory law entitles you, as a consumer, to bring proceedings in the courts of your place of residence.
19. Consumer Cooling-off Rights
Where you are a consumer entitled to a statutory cooling-off/withdrawal right under mandatory law in your country of residence (for example, the 14-day withdrawal right for consumers in the EU/UK), that right applies. However, such rights generally do not apply to contracts for leisure activities tied to a specific date or period of performance — which includes most Activities on the Koreesta Platform (dated tours, day trips, entrance tickets, guided tours, water activities, adventures, and combination offers). Where a cooling-off right does apply and you request that services begin during the cooling-off period, you may be charged proportionally for what has been provided up to the point of withdrawal.
20. Final Provisions
20.1. We may engage Koreesta subsidiaries and third parties as agents to perform obligations and exercise rights under these Terms and Conditions.
20.2. We may amend these Terms and Conditions in future — for example, to reflect changes in law, market conditions or regulatory requirements. We will inform you of material changes in a timely and appropriate manner. If you object, either party may terminate your account or access to the Koreesta Platform with immediate effect.
20.3. All notices and declarations under these Terms and Conditions must be made in writing (e.g., by email or through the Koreesta Platform).
20.4. The contract between you and us is formed and entered into in Sri Lanka.
20.5. In these Terms and Conditions: (i) “including” means “including but not limited to”; (ii) general words are not given a restrictive meaning merely because they follow words indicating a particular class; and (iii) words in the singular include the plural and vice versa. Section headings are for convenience only and shall not be used in construing these Terms and Conditions.
